Shadow report for the fifth periodic review of the United States under the International Covenant on Civil and Political Rights

This report provides data, research, and analysis on the U.S. treatment of foreign nationals, including migrants, refugees, and asylum seekers that violates the International Covenant on Civil and Political Rights (ICCPR). It focuses on Black people in transnational migration, including Haitians, Cameroonians, and other people of African descent.

The report details violations of the right to life and security of the person, the right to non-discrimination, the right to an effective remedy, the right to self-determination, and the prohibitions on torture and cruel, inhumane or degrading treatment or punishment and refoulement. It describes how U.S. immigration officials violate the rights of persons deprived of their liberty and use excessive force against non-citizens, in particular Black people .

What solutions exist?

The report calls for the United Nations Human Rights Committee to issue concluding observations following its review of U.S. compliance with ICCPR and to provide recommendations on how the United States can remedy violations of human rights of non-citizens.
