Law360: Ga. Judge’s Halt Of Deportation Too Late For Pregnant Woman

Law360 reports that a Georgia federal judge temporarily blocked U.S. Immigration and Customs Enforcement from deporting Zharick Daniela Buitrago Ortiz, who said she was eight months pregnant and in medical distress, but the order came too late to stop her removal. Ortiz is represented by Alexandra M. Smolyar and Meredith Yoon of Asian Americans Advancing Justice-Atlanta, as well as Anthony Enriquez, Sarah E. Decker, and Sarah T. Gillman of the Robert & Ethel Kennedy Human Rights Center.

“Using Tren de Aragua as a boogeyman to deport 8-month-pregnant women in medical distress is farcical,” said Anthony Enriquez, our vice president of U.S. advocacy and litigation at the Robert & Ethel Kennedy Human Rights Center. “Americans see through the government’s transparent attempts to deflect from its cruel and dangerous treatment of vulnerable people. Enough is enough.”

The case raises serious due process concerns about deportations carried out despite pending court review and claims of medical emergency.
