More than 200 organizations and people have signed on to a call urging Argentina, Brazil, Chile, Colombia, and Paraguay to cease their actions aimed at restricting the effectiveness of the bodies of the Interamerican Human Rights System (IAHRS).
The Americas, May 2, 2019 - The undersigned organizations, members of the International Coalition of Human Rights Organizations in the Americas and other civil society groups, express our alarm at the declarations made by five States of the region questioning the functioning of the Interamerican Human Rights System (IAHRS). This pronouncement seems to reflect a coordinated effort to weaken the promotion and protection of human rights in the continent, as it looks to cut back on the powers of the Interamerican Commission and Court of Human Rights.
This past April 23, a press statement published by the Chilean Consulate announced that the governments of Argentina, Brazil, Chile, Colombia, and Paraguay, had submitted to the Executive Secretary of the Interamerican Commission of Human Rights a declaration that questioned the “operation, functioning, and effectiveness” of the IAHRS. The signatory states emphasized the necessity of giving greater deference to the States in considering their political, economic, and social realities, particularly in relation to reparation measures. At the same time, they questioned the interpretation techniques of the Interamerican System, the scope of reparation measures, and the effects of international judgments that have restricted the complainant States. Additionally, they put under scrutiny the measures adopted by the Interamerican Commission (IACHR) to resolve the individual case backlog.
As human rights organizations of the Americas, we find the tone of the suggestions extremely worrisome, as all are of a restrictive character and lack a basis under the norms recognized in international law, and at the same time would lead to major backsliding for the proper functioning of the IAHRS. We recall that, between 2011 and 2014, a group of States made a similar challenge, principally directed at the IACHR, that ended in a reform of the regulations. In this sense, the declaration takes place in a context of prior efforts that aim to condition the actions and impact of the IAHRS bodies, prejudicing their autonomy and independence. It is important to note that all of the signatory states have multiple pending cases before the IAHRS.
In response, the signatory organizations call on Argentina, Brazil, Chile, Colombia, and Paraguay to abstain from any actions aimed at restricting the effectiveness of the regional protection mechanisms that would prejudice the fundamental rights of their citizens and the victims of grave human rights violations. Particularly, given the actual context of high levels of violence and impunity, we invite the States to develop an internal process of reflection to guarantee a greater compliance with the recommendations of the IAHRS, with the hope of contributing to its effectiveness.
From our respective countries, we reaffirm our commitment to continue supporting the powers and impact of the regional human rights system so that it can respond to the realities of our continent. We remain firm in our work to guarantee that the bodies of the IAHRS work in an autonomous, independent, and effective manner, offering a defense of human rights that comes from a collective and inclusive effort. Similarly, we call on the rest of the States of the region to join this effort.
